SC asks senior lawyer to examine whether Mahatma Gandhi assassination can be probed again

The Supreme court on Friday appointed senior Advocate Amarendra Sharan to assist it in examining whether Mahatma Gandhi’s assassination can be probed again.

A bench comprising Justices S A Bobde and L Nageswara Rao asked Sharan to ascertain whether there is material evidence to accept the petition seeking re-investigation into an assassination that took place seven decades ago.

Gandhi was shot dead at point blank range in New Delhi on January 30, 1948 by Nathuram Vinayak Godse, an advocate of right-wing Hindu nationalism.

The petition filed by Mumbai-based Dr Pankaj Phadnis , a researcher and a trustee of Abhinav Bharat, has sought reopening of the probe on several grounds, claiming it was one of the biggest cover-ups in history.

 

 
 


“We can’t go by political passions. The human being should be existing to face a trial if you want to order further investigation,” the bench told the petitioner.

The petitioner asked the court to conduct forensic test of the documents written by police inspector who had apprehended Nathuram Godse.

“He said the documents are there, although he passed away recently,” the petitioner submitted.

However, the court felt that it was not possible to establish the documents the officer had prepared before the court of law. Yet, it gave four weeks to Sharan to look into the record Phadnis has.
