Supreme Court asks AIMPLB: Can a woman be given option to say 'no' to triple talaq.

New Delhi: The Supreme Court on Wednesday asked the All India Muslim Personal Law Board (AIMPLB) regardless of whether a woman can be given a choice to state "no" to triple talaq at the season of execution of 'nikahnama'.

Boss Justice of India Jagdish Singh Khehar, who alongside four different judges, is hearing a group of petitions testing the sacred legitimacy of triple talaq today proposed senior lawyer Kapil Sibal, speaking to the AIMPLB that a statement can be included the nikaahnama to state that the marriage can't be broken up by the spouse by articulating moment triple talaq.

The AIMPLB lawyer said that the board acknowledges the proposals in all lowliness and will investigate it.

The SC bench likewise needed to know from AIMPLB that whether the board's counseling will be trailed by the Qazis at the ground level.

To this question, one of AIMPLB's lawyer Yousuf Muchala told the SC seat that board's consultative is not compulsory for all Qazis to take after.

Today is the fifth day of the hearing on a grasp of petitions testing triple talaq, polygamy and 'nikah halala' which is going ahead before a seat involving individuals from various religious groups including Sikh, Christian, Parsi, Hindu and Muslim.

The AIMPLB on Tuesday told the Supreme Court that triple talaq was a "sin and undesirable" act, yet at the same time passable and endeavors are on to instruct the group against its abuse.

"If I have faith that Lord Rama was born at Ayodhya, then it's a matter of faith and there is no question of constitutional morality" and it cannot be interfered with by a court of law Sibal said while drawing an analogy between triple talaq and the belief about Lord Rama.

"Triple talaq has been there since 637 AD. Who are we to state this is un-Islamic. Muslims are honing it for most recent 1,400 years. It involves confidence. Thus, there is no doubt of established profound quality and value," he told the five-judge Constitution bench.

The Constitution seat contains Chief Justice JS Khehar, Justice Kurian Joseph, Justice Rohinton Fali Nariman, Justice Uday Umesh Lalit and Justice S Abdul Nazeer.
