Cheated by a developer Heres how to register a complaint with RERA

In the recent past, there have been many such instances where the complainant has been compensated for delayed possession and misrepresentation by the builder.

 
 

New Delhi: Before the implementation of Real Estate Regulation and Development Act (RERA) in 2017, homebuyers had no other way to complaint against their developer except the consumer court in case of either a delay in project completion or in case of a mismatch in what was promised and what was actually delivered. But now with many states implementing RERA, homebuyers cheated by builders can approach the authority to take action against the developer. In the recent past, there have been many such instances where the complainant has been compensated for delayed possession and misrepresentation by the builder.
 
The MahaRERA in a recent adjudication allowed the complainant to withdraw from the project and directed the company to refund Rs1.9 crore with interest, and pay a compensation of Rs 2 lakh for misrepresentation on access to amenities offered. So, if you feel that your developer has cheated your or has not delivered what it had promised earlier, then you can register a complaint with the respective state RERA.
 
 

 
 

Here is how you can file a complaint with your state RERA against a developer
 
1) Log on to RERA authority's website and register as a complainant
 
2) Provide your details like email id, mobile number etc.
 
3) Go to accounts>>My profile and enter details asked for
 
4) Click on 'Complaint Details' tab and choose 'Add New Complaint'
 
5) Provide details asked for, including the project's registration numbers, and the respondent's antecedents
 
6) Share facts of your case and upload relevant documents
 
7) Specify the nature of relief you are seeking, explaining the grounds and the relevant legal provisions
 
8) You have to give a declaration of having provided accurate information and pay the requisite fees online.
 
9) A RERA adjudicating officer will hear your case and issue an order if merit found in your claim
 
10) If you don't get satisfied with the adjudicating officer's order, you can approach the appellate tribunal within 60 days from receipt of the order.
